The thesis is an independent scientific work dedicated to the study of theoretical and practical problems of the contract on establishment of easement under the civil legislation of Ukraine. Proposed the modern concept of civil-legal regulation of the contract on establishment of easement, with consideration of the peculiarities of its legal regulation, the grounds of detention, the object and subject composition. The analysis of scientific approaches to the definition of the agreement on the establishment of an easement in the domestic and foreign civil law thought. Analyzed the legal nature of the contract for the easement, its characteristic features. Researched the subject structure of the contract about establishment of the easement and explained features of the subject contract. The agreement on the establishment of an easement in the system of civil contracts and especially its conclusion. Covers the rights and obligations of the parties. Special attention is paid to the bases and limits of liability under the contract. Proposals for amendments to the current legislation of Ukraine.
