Murtishcheva A. Constitutional and legal liability of government in the European Union countries: a comparative analysis.

The dissertation gives a detailed description of the theoretical foundations and legal regulation of the constitutional and legal liability of the government in the EU countries. The notion, main features, the correlation between the constitutional and legal liability of the government with the political liability are defined. The functions and role of the constitutional and legal liability of the supreme body of executive power in ensuring constitutional legality have been described. Its forms are systematized and the sources of regulation are classified. The notion, elements of constitutional offense, the implementation mechanism of constitutional and legal liability forms are described. Scientific ideas about the correlation of constitutional and legal and criminal liability of government officials in EU countries, the instance of constitutional and legal liability of the government, have been further developed. Several recommendations on the improvement of legal regulation and elements of the implementation mechanism of the constitutional and legal liability of the Cabinet of Ministers of Ukraine have been formulated.
