Kovalskyi M. Civil Regulation of the Provision of Medical Services in the Field of Transplantation of Anatomical Material.

The thesis is a complex scientific study of civil regulation of the provision of medical services in the field of transplantation of anatomical material. The study defined the historical stages of the development of legal regulation of the provision of medical services in the field of transplantation of anatomical material. It includes the comparative legal analysis in the sphere of regulation of the chosen research topic in foreign countries. It is suggested to use the positive experience of other countries. The research of civil law relations arising during the provision of services in the field of transplantation of anatomical material allowed to determine the reasons for their emergence. It covered the contractual regulation of these legal relations and provided their characteristics. Donated anatomical materials are considered in the system of civil law objects. The problems of legislation that arise in the regulation of the provision of medical services in the field of transplantation of anatomical material are analyzed. On the basis of the analysis, it is proposed to determine the ways of optimization of legislation in the specified field. The research of case law allowed to propose the alternative ways of resolving disputes that arise between participants of legal relations in the provision of medical services in the field of transplantation. The conducted research created the basis for offering proposals and recommendations on improvement of certain norms of the legislation of Ukraine.
