Balichev O. Special types of complicity in terrorism under the criminal legislation of Ukraine

The dissertation is devoted to the complex investigation of terrorist crimes within the framework of complicity institute. In the course of the work, the state of scientific elaboration of the problem of defining terrorism as a legal category, as well as its concepts and features in the doctrine of criminal law, were investigated. The author defines the term «terrorism» and defines its main features. The terms «terrorism», «terrorist crimes», «terrorist activity», «terrorist offenses», «terrorist crimes» are classified. The necessity to make changes to Art. 1 of the Law of Ukraine «On Combating Terrorism» on the definition of the terms «terrorist group» and «terrorist organization». Objective and subjective signs of the crimes provided for in Articles 258–258-5 of the Criminal Code of Ukraine are identified. The author defines the concept of public safety. The subject of terrorist financing has been identified. It is concluded that the crimes provided for in Articles 258-1–258-5 of the Criminal Code of Ukraine contribute to the commission of a terrorist act and, by their legal nature, are special types of complicity, which the legislator singled out as separate rules in connection with their increased social danger. The problems of realization of criminal responsibility for terrorist crimes are outlined. Proposals have been made to improve domestic legislation on criminal liability for terrorist offenses
