Kliuchyk Y. Criminal liability for crimes related to bankruptcy

The dissertation is devoted to the complex investigation of bankruptcy crimes. The place and role of the crimes envisaged by Articles 218-1, 219, 220-1, 220-2 of the Criminal Code of Ukraine in the system of crimes in the sphere of economic activity are analyzed. It is noted that the crimes envisaged by Articles 218-1, 219, 220-1, 220-2 of the Criminal Code of Ukraine are committed in the sphere of bankruptcy, banking and financial relations. The objective signs of bankruptcy crimes are being investigated. Specific, main direct and additional (compulsory and optional) objects of the crimes provided by Articles 218-1, 219, 220-1, 220-2 of the Criminal Code of Ukraine are determined, as well as - the victim of the crime, provided by Articles 218-1 and 219 of the Criminal Code of Ukraine. It is established that the crimes envisaged by Articles 218-1 and 219 of the Criminal Code of Ukraine can be committed both through active action and through inaction. The subjective features of bankruptcy crimes are characterized. Identified the subject of the crime under Art. 220-2 of the Criminal Code of Ukraine. Bankruptcy criminal investigations and possible solutions are investigated. Proposals for improvement of the legislation on criminal liability for crimes provided by Articles 218-1, 219, 220-1, 220-2 of the Criminal Code of Ukraine are submitted
