The thesis is a comprehensive scientific research of theoretical and practical problems of the social dialogue in Ukraine. The dissertation presents a theoretical generalization and a new solution to a scientific problem, which is to comprehensively characterize the legal regulation of termination of an employment contract under item A. 41, paragraph 3 of the Labor Code of Ukraine and to identify current trends in the development of regulatory support in the relevant field, taking into account the reform of the education and labor law. The main form of realization of the right to work - the employment contract under which the employee realizing educational activity as the overwhelming part of the labor function, as well as the legal possibilities of the parties to the employment contract at its termination under item 3 of Article 41 of the Labor Code of Ukraine, is investigated. The employment contract is considered as a dynamic form of realization by the employee performing the educational function, the right to work, which carries out pedagogical activity, which is inextricably linked with the implementation of the educational process, during which the realization of the educational function as the main component of the work function of such a professional will take place
