Essay

The dissertation is devoted to the complex research of reassignment to another position and dismissal as measures of prevention of corruption and arrangement of conflicts of interests and directions of their improvement. In this connection, the current state of scientific development of the problems of preventing corruption and arrangement of conflicts of interest in labor law is defined. The definition of the concept of labor and legal measures for the prevention of corruption and arrangement of conflicts of interest is given, and their essential features are formulated, and the types are specified. Historical and legal genesis and foreign experience of preventing corruption and arrangement of conflicts of interest are analyzed. Besides, opportunities for its implementation in Ukraine are identified. The grounds for dismissal of the employee in case of violation of the restriction after termination of activity are thoroughly investigated, on the basis of the domestic practice, which is related to the performance of functions of the state, local self-government; reassignment and dismissal of an employee in case of breach of restriction on the work of close persons and in connection with the presence of conflict of interest, deficiencies are identified, and remedial measures are proposed.
