Lukianchuk O. Children’s obligation to support their parents under the Family Code of Ukraine

The thesis is a complex research of the issues of procedural of the problem of the responsibility of children to keep their parents under the family law of Ukraine. The theoretical, legal, methodological and legal principles of the obligation of children to support their parents under the family law of Ukraine are investigated. In the relevant context, the state of scientific development of the problem of parental maintenance is determined, the methodology of the research is given, the evolution of legal regulation of the institution of parental maintenance is traced. The concept of the obligation of children to maintenance parents is defined, the legal composition on the basis of which the obligation of children to support parents arises. It is determined under what circumstances parents will be considered in need of financial assistance. The grounds of voluntary fulfilment of the obligation of the child to support the parents and the compulsory collection of alimony for the maintenance of the parents, the additional expenses for their care and treatment, as well as recovering by the court's decision costs for cover the costs of providing parental maintenance. Based on the above provisions, a number of proposals have been developed to optimize the family and civil procedural legislation of Ukraine regarding the legal regulation of the obligation of children to support their parents.
