Essay

The dissertation is devoted to establishing the theoretical and legal aspects of correlation of lawmaking of the Supreme Court and the Constitutional Court of Ukraine, determination of problems of its legal support and strengthening of interconnection. The scientific work analyzes the history of the development of perceptions of judicial lawmaking, on the basis of which it is established that judicial lawmaking till the end of XVIII century does not receive its scientific highlight. From the beginning of ХІХ century the problem of judicial lawmaking is distinguished as an independent object of scientific research, studied through the prism of basic approaches to law. The state of scientific research of judicial law-making by the criteria is summarized: the content of scientific researches (historical-legal, comparative-legal, categorical, system- structural, institutional-legal, praxeological researches); structures of legal science (theoretical, historical, branch-legal, specially-applied researches), etc.
