Pichko R. Insurance as a mechanism to safeguard, enforcement and protection of intellectual property rights

The dissertation is devoted to the research and justification the insurance theoretical foundations of insurance using as mechanism to safeguard, enforcement and protection of intellectual property rights. The beginning and development of insurance from ancient times to today are investigated in detail by author. The insurance role in the society development as a special mechanism is shown, that allows to transfer the consequences of the alleged occurred risk to some person other and activities more freely for insured person. In the dissertation is given a general theoretical characteristic of insurance interest, insurance risk, object and subject of insurance, protection and defense of rights, inviolability of intellectual property rights, exclusive right, security function of insurance, voluntary insurance of intellectual property rights. The essence analysis of the insurance legal relationship, security insurance function in intellectual property rights of voluntary insurance implementing are investigated in detail. The nature of the insurance contract as a formalization of the insurance legal relationship is investigated .The considerable attention is devoted to effects of insurance on the protection and enforcement of intellectual property rights. It is considered to effects of insurance on strengthening the protection of intellectual property rights.
