Pustovit O. Administrative-Legal Status of State Control Bodies in Field of Quality and Safety of Agricultural Products

The dissertation deals with the actual issues of the administrative and legal status of the bodies of state administration in the field of quality and safety of agricultural products. The current situation in development of the state is characterized not only by activation, but by radical reformation of all spheres of public life. The need for change, a new role on the international scene, an internal political stance, a new vision of living standards of the population, relates the notion of such reforms with the concepts of progress and improvement. The paper presents international experience on issues related to the quality and safety of agricultural products. Taking into account the signing of the EU-Ukraine Association Agreement, it is important to study the experience of regulation of the sphere on the example of individual EU member states (Germany, Belgium, Poland, Great Britain, Estonia). The system of bodies of management of a branch of safety of products is revealed. The international documents, approaches, the policy of regulation of the sphere of quality and safety of agricultural products are analyzed. In particular, the role of European law in approaching the concepts of «safety» and «quality» plays a key role, since the latter is a purely commercial, market-based term. It is determined that the mechanism of cooperation between state authorities and local self-government bodies allows to increase the efficiency of state control in the field of control over the quality and safety of products. Under the interaction of state authorities and other bodies of state authority in the field of quality and safety of agricultural products, the activity of management bodies based on the current legislation shall be understood to be consistent with the purposes within their competence, aimed at unconditional compliance by the natural and legal persons with the requirements of the current legislation on agri-food products in coordinates of quality and safety. The problem issues related to the development of international legal cooperation between Ukraine and FAO and the priority directions of Ukraine’s activity in the issue of improving the national legislation, in particular in the field of scientific and technical development of agriculture, as well as the development of international relations in this area and the improvement of the current legislation.
