Bilak O. Fair Trial as a Criterion for the Effectiveness of the Mechanism of Protection of rights and freedoms of Human and Citizen

The dissertation provides a theoretical generalization and presents a new solution to an important scientific problem, which is to form a holistic concept of definition, participation, implementation of international inter-municipal cooperation of border regions of Ukraine in the context of today's European integration processes. In view of this, a number of scientific provisions, conclusions and proposals for improving the regulation of the Constitution of Ukraine and other regulations of cross-border cooperation of municipalities of border regions. Based on the analysis of the general theoretical meaning of the terms "concept", "category", "cross-border", "cooperation" and the Constitution of Ukraine, it is established that cross-border cooperation is a category of constitutional science and distinguishes cross-border cooperation from other types of cooperation. Signs of cross-border cooperation are highlighted. The author's definition of the concept of "cross-border cooperation" is offered. General and special features of the constitutional institute of cross-border cooperation are formulated. The constitutional content of cross-border cooperation is determined. Based on the results of the study of the legal basis of cross-border cooperation in the European Union and in Ukraine, a number of differences in the understanding of this category by these legal systems have been identified. The author's definition of the term "inter-municipal cooperation" is offered. The stages of evolution of inter-municipal relations construction in Ukraine are highlighted.
