Sen I. Special norms in criminal law of Ukraine

It is found out that the state of scientific study of the problem of special criminal law norms at present does not fully meet the needs of law-making and law-enforcement. Historical analysis of special norms in Ukrainian criminal law acts has been conducted. Therefore, it is established that special norms were used by the legislator at all historical stages of development of our statehood. The experience of the use of articles containing special norms in the foreign criminal laws is analyzed. It is established that the majority of the foreign criminal laws are characterized by the presence of articles containing special norms in them. On the basis of formal and logical study of special norms in criminal law, it is concluded that general and special criminal law norms are in the logical correlation of subordination, and several special norms are in the logical correlation of intersection of concepts.
