Essay

The dissertation is a criminological research of crimes committed in the field of production and circulation of alcoholic beverages, the identity of the offender, determining the complex of criminal behavior. Based on the results of an empirical study of trends in these crimes, the mechanism of the market for illicit alcohol and the generalization of international experience in combating this phenomenon developed a set of measures for general social and special criminological prevention of these crimes. In practice, the illicit production and trafficking of alcoholic beverages is mainly in the form of illegal entrepreneurship (criminal business). One-time crimes in this area are rare. The purpose of illegal entrepreneurship is to obtain maximum income from the sale of alcoholic beverages of illegal origin. It was found that the underground industry of illegal production of alcoholic beverages in Ukraine mainly works to meet the demand for cheap and low-quality alcoholic beverages in the domestic consumer market. The main sales channels of alcoholic beverages of illegal origin in the consumer market of Ukraine are wholesale and retail sales via the Internet; sales through a network of retail outlets; sale for bottling through catering establishments. The main role in determining the crimes under investigation is played by economic factors. Among them is the growth of alcohol consumption in Ukraine and the world; low purchasing power of the population; significant difference in prices for alcoholic beverages of legal and illegal origin; high rates of excise tax, etc. A systematic approach to solving the problem of illegal production and circulation of alcoholic beverages is proposed, which covers the following areas: thoughtful reform of the alcohol and alcoholic beverages industry; implementation of recommendations of international program documents of the WHO, UN, EU on prevention and reduction of harmful alcohol consumption; shifting the priorities of preventive activities for the production of alcoholic beverages to the market and illegal trade activities; introduction in Ukraine of an international system for detection and tracking of excisable goods during their movement along the supply chain (Track & Trace); liberalization of pricing policy for alcoholic beverages; improving the mechanism of state control over the quality and safety of alcoholic beverages; detection and cessation of criminal activity related to the illegal production and circulation of alcoholic beverages.
