Essay

The dissertation carried out an in-depth analysis of important aspects of Ukraine’s implementation of international standards in the field of protection of the rights of convicts in places of non-freedom and, from the point of view of complexity and systemality, made a theoretical synthesis and gave practical proposals for their implementation in the practical activities of penitentiary institutions of the Ministry of Justice of Ukraine. The most important international documents specifically devoted to the rights of convicts in places of non-freedom – the Standard Minimum Rules for the Treatment of Convicts, the Convention against Torture, the Istanbul Protocol and the like – were analysed. The author’s definition of the basic concept studied in the dissertation is provided. International standards for the protection of the rights of convicted persons in places of non-freedom are systematized and classified. It is hypothesized that international standards for the protection of the rights of convicts in places of non-freedom form their specific status, in connection with the entry of a person by a court verdict into the status of a convict. It has been established that international prison cooperation is possible at any stage of execution and serving a sentence. It is proposed to consider ways for Ukraine to implement international standards in the field of protection of the rights of convicts in places of non-freedom, both at the legislative and practical level.
