Pavroz T. Constitutional and legal status of the church in Ukraine and foreign countries

The dissertation is devoted to the study of the constitutional legal status of the church in Ukraine and foreign countries. The doctrine, genesis and legal regulation of the status of the church in Ukraine and foreign countries are examined, the research methodology, the concept and elements of the constitutional legal status of the church in Ukraine are disclosed, the constitutional and legal status of the church in foreign countries is analyzed based on the classification of countries as common, continental and traditional law. The definition of the constitutional legal status of the church and the legal construction of the constitutional status of the church was substantiated, which consists of the following structural elements: 1) legal personality; 2) principles; 3) rights and obligations; 4) guarantees; 5) legal liability. The analysis of the current legislation of Ukraine, which secures the constitutional and legal status of the church. Based on the analysis of the current legislation of Ukraine, it was revealed that certain rules governing the constitutional and legal status of the church in Ukraine contain certain shortcomings, as a result of which changes are proposed in the current legislation regulating this issue with a view to improving it. The constitutional and legal status of the church in foreign countries of common, continental and traditional law is analyzed, general and distinctive features, as well as the main features, are inherent in them.
