Essay

Thesis is a complex theoretical study of decentralisation of the public authority in the legal theory and state-building practice. Genesis of the idea of decentralisation in world politico-legal thought and state-building practice are analysed in this dissertation. The essence of the decentralisation and peculiarities of its defining in the theory of state and law are researched. Historiography and methodology of the study of decentralisation of the public authority are studied by the author. In the thesis, based on the experience of the european democracies, basic modern concepts of the decentralisaton of the authority are generalized. Author defined features and patterns of decentralisation of the public authority in unitary state along with correlation of decentralisation and federalization notions. Influence of globalization as a legal notion on decentralisation of the public authority is analysed. Peculiarities of decentralisation of the authority in a context of democratical transformation are generalized by the author. The complex analisys of legal and regulatory framework of decentralisation in Ukraine and of the reformation process of a local government as a kind of the public authority decentralisation was held. The problems of constitutional reform regarding the power decentralization in Ukraine and the possibility of improving the process of transferring functions and authority from the central government to the local government are pointed out.
