Ustiuzhaninova O. Criminal-executive principles of functioning of SPS of Ukraine

The dissertation is devoted to the complex research of criminal-executive bases of functioning of SPS of Ukraine. The paper substantiates a number of provisions and conclusions that are new in conceptual terms and important for legal science, as well as the activities of the SPS of Ukraine. The author's definition of the concept «criminal-executive principles of functioning of SPS of Ukraine» under which the author understands initial normative-administrative and institutional provisions which provide realization of tasks of SPS of Ukraine on various functional directions by application of norms of criminal, criminal-executive and criminal procedural legislation, and also departmental (interdepartmental) regulations governing the procedure and conditions of execution and serving of criminal sentences and probation and the concept of «institutional factors influencing the functioning of the State Penitentiary Service of Ukraine» which means factors related to the management of the State Penitentiary Service of Ukraine and regulation certain areas of implementation of state policy in the field of execution of criminal punishments, which have both positive and negative impact on the state of regulation of social relations that arise in the process of execution and serving a sentence; the classification of institutional factors into criminological, social and criminal-executive.
