The work is devoted to solving an urgent scientific problem, which is to develop theoretical provisions for optimization of public administration in Ukraine on the basis of human rights, meeting the needs of the current status and stage of the Ukrainian society development. It is proved that human rights and freedoms, as well as state guarantees of their provision and protection determine the essence and direction of administrative activity of the state.
Theoretical foundation and practical possibilities of optimization of the public administration system in Ukraine on the basis of human rights in the context of international experience are argued. The essence of optimization of public administration amid reforms on the basis of human rights is revealed; human rights as an object of scientific research in their moral, legal and political perspective are characterized; the values of public administration on the basis of human rights are substantiated and systematized; institutional processes concerning formation of the infrastructure for the protection of human rights and their extension to the business sphere in Ukraine are analyzed; legal mechanisms and instruments for the protection of human rights are identified; the priorities of sustainable development and practical imperatives for the implementation of the latest paradigm of public administration on the basis of human rights are substantiated; local self-government is considered as a guarantor of human rights in the context of international practice of their implementation at the municipal level; the features of implementation and protection of human rights in the Law Enforcement structures of the Security and Defense Sector (SDS) are identified. Optimization on the basis of human rights is seen as a modification of this system in order to increase its efficiency through the synergistic effect of human rights realization through the implementation of human rights-based sectoral policies and administration practices: universality of human rights determines the formation and functioning of optimal administration system that covers all spheres of society and management, increases the level of public legitimacy of power and thus ensures full support of the nation, which significantly increases the efficiency and effectiveness of the entire governing body as a system. The public administration values are conceptually defined and systematized: it is proved that public administration values, their definition and classification, allow outlining the range of values of public services and offer an adequate understanding of the role they play in the administration activities. Based on the principles and standards of human rights the public administration values are the basis for evaluating and selecting the most acceptable alternatives to management decisions from the standpoint of the public benefit and significance. In organizational terms, it is the values of public administration that determine the guiding principles of integrity and desirable behavior of civil servants while performing official duties on the basis of human rights. As a criterion for the expediency of management decisions which is basis of the public administration mission in modern society, “public administration values ” are manifested at all discrete stages of management, in any country, regardless of level and place, structure and functional load of public administration: they form a moral background for achieving the goals of public administration. As a separate type of values, the public administration values offer a normative consensus between the rights, privileges and prerogatives to which citizens should (or should not) be entitled, obligations of citizens before the society, the state and each other and principles on which governmental and political practices are based. It has been proved that public administration bodies are able to perform their functions on the basis of human rights and freedoms, establishing an appropriate level of social justice in the society and ensuring public order and security through successful democratic reforms, including regulation of property rights based on the rule of law, providing infrastructure and technological capabilities; access, participation and informed choice of the population in the formation of policies and their implementation at the local level.
Recommendations for the implementation of post-conflict governance in peaceful areas, in frontline settlements, and later in towns and villages liberated from occupation have been developed based on the definition of a local human rights index. The need to clarify and update the essence, the content and the scope of constitutional human rights of the military personnel as citizens in uniform, implemented in Ukraine in the context of implementation of measures by the subjects
of democratic civil control.
