Essay

As a result of the analysis of international standards, practice of foreign countries, national legislation and law enforcement practice, statistical data, information obtained on the basis of author's public opinion poll, the dissertation investigates problems related to the development of scientifically sound concept of constitutional-legal principles of electronic government in Ukraine. The current state of e-government in Ukraine is characterized and positive trends are identified. Based on authoritative international monitoring and scientific positions, it has been proven that the level of political and legal activity of citizens is currently declining, traditional ties between citizens and political elites are weakening, electronic tools including the Internet, social media sites and open data can help mobilize voters, increase the participation of citizens in the state and legal process, improve the provision of public services, promote innovation and economic growth and strengthen democracy. Emphasis is placed on a number of globalization challenges to democracy, including the pandemic caused by COVID-19, which is one of the most representative challenge to human rights and the role of the state. The way to overcome such challenges is the proper functioning of e-government, which is a mean of improving and developing of representative democracy through the emergence of new ways and opportunities for participation. The basic principles of e-government functioning in a democratic society are determined, which are proposed to be introduced into the Concept of e-government development in Ukraine. It is positioned that the main task of e-government is to ensure and protect the constitutional rights and freedoms of citizens by the state. The compliance with functioning of certain elements of e-government in Ukraine with the Action Plan for the implementation of the National Strategy in the field of human rights for the period up to 2020 as the main normative reference point of implementation of the progressive international standard in various spheres is analyzed. Borrowing positive experience at the national level, requirements are set for the possibility of functional support of the petition form of participation of citizens and preservation of confidentiality of the information.
