BUDIACHENKO O. Criminal liability for illegal felling of timber or illegal transportation, storage, sale of forest

The thesis is devoted to a comprehensive study of criminal law problems of liability for illegal felling of timber or illegal transportation, storage, sale of forests in Ukraine. The formation and development of legislation on criminal liability for illegal felling of timber or illegal transportation, storage, sale of forests in Ukraine, as well as the peculiarities of foreign experience in the legislative regulation of such liability. The analysis of objective signs of the crime provided by Art. 246 of the Criminal Code of Ukraine and outlines its subjective features. The peculiarities of the qualification of a crime for illegal felling of timber or illegal transportation, storage, sale of forest are analyzed, and on the basis of generalization of judicial and law enforcement practice the corresponding recommendations of improvement of punishment in this sphere are developed. The thesis research contains proposals for improving the current legislation, offers a new version of Art. 246 of the Criminal Code of Ukraine.
