The dissertation presents the solution of the scientific problem of substantiation of theoretical provisions and the development of practical recommendations for improving the mechanism of business law support of small business in Ukraine. The relevance of the dissertation topic is due to the need to improve the existing mechanisms of state regulation of small business in Ukraine, the means of stimulating and supporting, regulating the legal status of small business entities, which will allow us to move to a new qualitative level of economic development. It is determined that small business can be considered as an object of structural and sectoral policy and a significant segment in the structure of the national economy of the state as a macro-object of economic policy of the state, to develop programs of economic development necessary in view of the strategic development of small business. The necessity to grant the Office of Development of Small and Medium-Sized Entrepreneurship the status of a central executive body was established. The concept of the state policy on support of small business as a set (complex) of priority decisions defining the main directions and forms of legal, economic and organizational assistance to the development of small business is taken into account, taking into account the interests of the state and economic entities. It is proposed to limit the possibilities of misuse of state support for small business by establishing a registration requirement – one natural person – one small business entity, that is, an individual may be the founder or co-founder of only one enterprise that can have the status of a small business. It is proposed to set the qualification criteria by which business entities can be classified as small businesses, namely the value of assets, the number of employees, as well as the volume of production and sale of products, consumption of electricity and other resources. An additional criterion for state support may be the specific legal personality of publicly beneficial activities. It is proposed to supplement the Commercial Code of Ukraine with such organizational and legal form as a family enterprise, which is a hybrid form and synthesizes in itself certain elements of such organizational and legal forms as a limited liability company, a limited partnership and a production cooperative.
