Essay

Thesis is devoted to the consideration of the peculiarities of the application of fines to minors. The author provides a description of the fine as the main and additional punishment for minors, identifies some problems that arise during its appointment, studies the main stages of origin and evolution of the studied type of criminal law influence. Particular attention is paid to the analysis of international and foreign legislation in the field of juvenile property penalties. The author emphasizes that criminal and financial fines are diametrically opposed types of penalties, and financial fines are more independent and full-fledged type of influence, as they cannot be replaced by other, opposite, punishments, unlike criminal fines, which can be replaced by public fines. or corrective work. It is pointed out that the essence of the fine is to recover material benefits in favor of the state, not the victim, although such an opinion is present in the doctrine of domestic criminal law and some regulations of foreign countries. Ways are proposed to improve criminal law in terms of applying fines to minors.
