Dikhtyaruk A. Constitutional and legal bases of realization of the right to higher education in Ukraine

The main historical and legal aspects of the formation and the evolution of the right to higher education in Ukraine are analyzed. The legal nature and the concept of the right of a person and a citizen to higher education are determined. The generalization of the author, with its formula, is proposed. The place of the right to higher education in the system of constitutional rights and freedoms is clarified. The legislative acts of Ukraine forming the basis of the legal definition and regulation of the right to education are presented. It is concluded that the domestic legislation in its principles complies with international legal standards of human rights, and constitutional principles and guarantees of human rights and citizens for higher education. It is affirmed that some constitutional acts and constitutional principles determine the functioning principles of the educational system as single unity also and as individual components.
