Essay

In domestic historical and legal science, this thesis is the first dedicated comprehensive study of the Bar tradition on the territory of Zakarpattia and its impact on the origin and development of an independent, full-fledged human rights institution of the national Ukrainian Bar with a clear structure, defined responsibilities and autonomy of the Bar in relation to judicial and law enforcement agencies in this region of Western Ukraine in the 19th – first half of the 20th century. The author describes the state of scientific development of the problem under study and develops the periodization of the history of the Bar of Zakarpattia. The thesis shows development and peculiarities of the historical and legal tradition of the formation of the Bar in the region from the end of the 10th to the beginning of the 19th century. It covers the issue of development of preconditions that enabled the further development of the Bar as an independent legal institution on the territory of Zakarpattia in the 19th century. The author identifies the main trend in the development of the region’s Bar as part of Austria-Hungary in 1874–1918, describes the process of formation of the Bar of the Carpathian Ruthenia (1919–1939) as a part of Czechoslovakia, considers the legal conditions for the formation of the Bar of Carpathian Ukraine (1938–1939) as well as their state on the territory of Zakarpattia as a part of Hungary (1939–1944). The thesis covers the genesis of the Bar institute of Zakarpattia-Ukraine (end of 1944 – beginning of 1946) and shows the course of Sovietization of the Bar Association of the Zakarpattia Oblast as a part of the Ukrainian SSR in 1946–1950.
