Essay

The research uncovers the historical development of ideas and views on the nature and essence of social human rights, their theoretical foundations: the conception, classification, and distinctive features. The essential difference between social rights from economic rights is illustrated. The author's definition of the concept of "social human rights" has been designed. Proceeding from the conducted analysis of the genesis of historical and legal approaches to the understanding of the nature and characteristic features of social rights, their classification is selected. The categories of "social protection", "social security" and "social security law" are explored. The right to housing, to an adequate standard of living, to health care, to a safe environment has been disclosed in a comprehensive and restricted sense. A definition of "guarantees of social rights" has been elaborated and their classification has been accomplished. The current trends of shifting approaches to the interaction between states and international mechanisms of rights protection toward the isolation of the former are presented. The increasing role of courts as implementers of social rights is highlighted, the problems of law enforcement and protection of social rights against the influence of crisis factors are analyzed.
