Tkachenko O. Criminal and criminological measures to prevent illegal felling or illegal transportation, storage, sale of timber in Ukraine

Thesis for a Candidate Degree in Law in specialty 12.00.08 – Criminal Law and Criminology; Criminal Enforcement Law (081 - Law). – Donetsk Law Institute of the Ministry of Internal Affairs of Ukraine. – Mariupol, 2021. The thesis is devoted to a comprehensive study of criminal law and criminological problems of preventing illegal felling or illegal transportation, storage, sale of timber in Ukraine. For the first time, a scientific task was posed and solved to develop a holistic theoretical and practical approach to the formation of a strategy for preventing such criminal offenses, which made it possible to substantiate proposals aimed at improving legislation and the practice of its application by units of the National Police. Provided the criminal law characteristics of criminal offenses provided for by Art. 246 of the Criminal Code of Ukraine and disclosed the features of foreign experience of law enforcement agencies in the prevention of such illegal actions. The structure and dynamics of such criminal offenses are characterized. The content of determinants contributing to the criminalization of the environment is revealed. A conceptual vision of ways of implementing legal and organizational measures of prevention at the general social, special-criminological and individual- preventive levels is proposed.
