Salmanov O. Procedural Arrangements for Conduction of Investigative (Search) Actions Restricting the Inviolability of Dwelling or Other Property of a Person

The object of research is public relations that arise, change and terminate in connection with the conduct of investigative (search) actions that limit the inviolability of housing or other property of a person. The purpose of the study is to obtain new scientific results aimed at improving the procedural order of investigative (search) actions that limit the inviolability of housing or other property of a person. The methodological basis of the research is the dialectical method of cognition of reality, general scientific and special research methods. Theoretical and practical results, novelty: investigative (search) actions that limit the inviolability of housing or other property of a person is defined as a set of cognitive and search actions related to penetration into housing or other property of a person carried out by authorized entities on the grounds and in the manner prescribed by criminal procedure law, in order to obtain and verify evidence and information about them; systematized and characterized investigative (search) actions that limit the inviolability of housing or other property of a person, according to the following criteria: the subject; the nature of the trace picture and methods used for its study; a sign of suddenness and conspiracy of purpose, time, place and methods of their conduct; the need to obtain permits for their conduct; their orientation; proposed classification of subjects of investigative (search) actions that limit the inviolability of housing or other property of a person, taking into account the functions they perform and their procedural interest. Degree of implementation: in the research field - for further development of procedural issues of investigative (search) actions that limit the inviolability of housing or other property of a person; in law-making - to improve the criminal procedural legislation of Ukraine in terms of regulating the procedure for conducting investigative (search) actions that limit the inviolability of housing or other property of a person; in law enforcement activities - as recommendations on investigative (search) actions that limit the inviolability of housing or other property of a person. Scope: in the educational process - during the teaching of disciplines "Criminal Procedure", "Pre-trial investigation", "Directions of science: criminal process", "Preparation of procedural documents at the stage of pre-trial investigation", preparation of individual units (chapters) of textbooks, training manuals and guidelines.
