Essay

The dissertation research is devoted to the history of development of legal responsibility in the period from X to the end of XX century. The process of origination of legal responsibility for forest violations by transformation of traditions, rites, rules of use of this natural resource into norms of customary law is shown. The provisions on forest protection in the ancient monuments of law of Ruska Pravda, Kyiv, Volyn privileges, the Statutes of the GDL of 1529, 1566, 1588 are studied. The connection between the forest protection articles of Ruska Pravda and the content of similar provisions of the Statutes of the GDL is proved. The process of formation of norms of legal responsibility in the Russian Empire is periodized, the presence of a significant range of sanctions is shown. The translation into the modern Ukrainian language was made, the Austrian law "On Forests" of 1852, which was in force in Galicia and Bukovina, was put into scientific circulation. The content of forest protection norms, sanctions for forest violations is considered, detailed regulation of all types of forest use is shown. The periodization of the Russian imperial legislation was carried out, the dynamics of the norms of legal responsibility for forest violations was studied, which varied from severe punishments to rather liberal ones. It is shown that in the Ukrainian People’s Republic there was a law "On Forests of the Ukrainian People’s Republic", which establishes rules of liability for forest violations, the authors of which were M.Yu. Shapoval and the director of the Forest Department prof. B.G. Ivanytsky.
