Tkachenko M. Contract of carriage by rail in the civil law of Ukraine.

The dissertation is devoted to research of theoretical and practical problems at the conclusion, change and termination of the contract of transportation by railway transport. The contract of transportation by rail as a civil law contract is separated from a similar contract of carriage, which is concluded in commercial law. The main and conflicting bindings used in concluding the contract of international transportation by rail have been clarified. The subject, parties, essential conditions of the contract of transportation by rail are defined. The classification of contracts of transportation by rail is carried out. The grounds and consequences of civil liability for violation of the terms of the contract of carriage by rail are considered. On the basis of the analysis of norms of the legislation of Ukraine which regulates contractual relations of transportation, offers on its improvement are developed.
