Kurashova I. Economic and legal mechanism of self-regulation of the construction industry in Ukraine.

The dissertation is devoted to the research of theoretical issues of economic and legal mechanism of self - regulation of the construction industry. The main conceptual apparatus of self - regulation of economic activity in general and in the construction industry in particular is characterized in the work, the corresponding author 's definitions are offered. Considerable attention is paid to the study of the peculiarities of the legal regulation of self-regulatory activities in foreign countries in order to learn from the positive experience and principles of legal regulation of the procedure and conditions of its implementation. The study of this issue was conducted on the basis of the analysis of domestic regulations of foreign countries and international documents. Particular attention is paid to the analysis of the current legal framework, the norms of which partially regulate the activities of self-regulatory organizations in priority sectors of the national economy, as well as legislative work, in particular, the dissertation analyzes submitted and registered in the Supreme Council of Ukraine self-regulatory organizations in Ukraine. It is noted that Ukraine is characterized by the lack of a unified and proper legal approach to streamlining self-regulation of economic activity. In single, mostly by-laws, certain concepts from the terminological apparatus of "self-regulation" are mentioned in fragments, but without their interpretation and the established uniform approach. As a result of the study, the concept of economic and legal mechanism of self-regulation of the construction industry as a comprehensive system of appropriate legal means and measures to ensure the creation and functioning of self-regulatory organizations in the construction industry, regulation of admission to certain activities in the construction industry, professional ethics , control over the activities of economic entities in the construction industry, compliance with the rules of conduct established by the relevant self-regulatory organization, as well as the procedure for bringing their own members to justice.
