Essay

The work is devoted to the study of relative independence, equality and review of decisions by discussion as constitutional and legal fundamentals of decision-making by the Verkhovna Rada of Ukraine, the Cabinet of Ministers of Ukraine and the Constitutional Court of Ukraine. The dissertation deals with the complex scientific development of the constitutional and legal fundamentals of decision-making by the higher collegial bodies of state power of Ukraine. A holistic view of the relative independence, equality and review of decisions by discussion of constitutional and legal fundamental principles of decision-making by the Verkhovna Rada of Ukraine, the Cabinet of Ministers of Ukraine and the Constitutional Court of Ukraine, their substantive and procedural components is formulated. The constitutional values on which the respective constitutional and legal principles are founded have been outlined. Particular attention is paid to the theoretical underpinnings of these fundamental principles through the lens of representative democracy and participatory democracy. The paper identifies perspective directions of improvement of national legislation in the sphere of decision-making by the higher collegial bodies of state power of Ukraine and formulates concrete proposals for it`s implementation.
