Hromova A. Invalidity of credit obligations under the civil legislation of Ukrai

The dissertation is the first special complex research of invalidity of credit obligations under the civil legislation of Ukraine in the domestic science of civil law. The dissertation considers the formation and development of legislation on the invalidity of credit obligations. The concepts, grounds, conditions and features of invalidation of credit obligations are defined. The legal nature of invalidity of credit obligations under the civil legislation of Ukraine is described. The ratio of invalidity of credit obligations with related legal categories has been clarified. The procedure for declaring credit obligations is determined as invalid. The legal consequences of invalidity of credit obligations under the civil legislation of Ukraine are investigated. The concept of invalidity of credit obligations is formulated, which should be understood as non-compliance of the loan agreement with the requirements of current legislation, and which does not create legal consequences due to defects in the structure, except for the consequences associated with its’ invalidity.
