The thesis research is a complex work devoted to the issue of criminal liability for illegal acts with poisonous or drastic substances that are not narcotic or psychotropic ones or their analogues, or poisonous or drastic pharmaceutical drugs under Art. 321 of the Criminal Code of Ukraine. Analysis of the norm of Art. 321 of the Criminal Code of Ukraine has been conducted comprehensively, the study began with the problems of criminal liability in general, the definition of this general theoretical concept and the disclosure of the content of social conditionality of the norms provided for by Art. 321 of the Criminal Code of Ukraine. According to the results of studying the case-law, it has been unquestionably confirmed that this norm is so to speak "dead". This circumstance suggested the expression of proposals concerning ways of its upgrading or even to resolve the issue of its continued existence.
