Lisniak V. Criminal Liability for the Violation of the Established Rules of Circulation of Narcotic Drugs, Psychotropic Substances, Their Analogues or Precursors.

Thesis is a complex research devoted to the issues of criminal liability for violation of the established rules of circulation of narcotic drugs, psychotropic substances, their analogues or precursors. A number of theoretical and practical problems of an application of criminal law provided by Art. 320 CC Ukraine are highlighted, and several proposals for the improvement of criminal law and law enforcement practice have been developed. The essence of the criminal-legal characteristic of the crime and social conditionality as its component is considered. Factors of criminalization of the act in the form of violation of the established rules of circulation of narcotic drugs, psychotropic substances, their analogues or precursors are described. It is established that Art. 320 CC Ukraine contains criminal law norms with double prevention. The idea of systematic exclusion of the concept of “analogues” from the description of the subject matter of the offence in the field of drug trafficking is being further developed and theoretically substantiated.
