It is emphasized that the current modern legislation on human rights, including the right to transplantation, exists in Ukraine, but the practice of law enforcement in the field of human rights is still in the process of improvement, it is the latest human rights and legislation on them is extremely dynamic. due to the use of the latest medical technologies, often with the use of the latest equipment, the experience of which is not available to most transplant doctors in Ukraine, all this creates many obstacles to the proper implementation of the right to transplantation. The author's definition of the concept "constitutional and legal mechanism for ensuring the right to transplantation in Ukraine" as a set of norms and principles of law on transplantation in Ukraine, as well as the system of authorized entities and their activities in the field of transplantation in Ukraine, its guarantee and protection. It is established that the main elements of the constitutional and legal mechanism for ensuring the right to transplantation in Ukraine are: realization of the right to transplantation in Ukraine; protection of the right to transplantation in Ukraine; guarantees of the right to transplantation in Ukraine.
