Essay

The dissertation investigates the essence of offenses related to the movement of goods/objects across the customs border, their current state and conceptual areas of prevention of this offense. For the first time, the idea of distinguishing offenses related to the movement of goods/objects across the customs border as a single criminological group of offenses, which includes crimes and administrative offenses, which are mainly a type of cross¬border shadow business, was presented. It was found that the fact of committing these offenses is in the nature of business activities carried out by organized structures. Such activities are accompanied by the establishment of persistent corruption links between offenders and regulatory agencies. A comprehensive criminological description of offenses was provided, quantitative and qualitative indicators of offenses related to the movement of goods/objects across the customs border in Ukraine, from 2005 to the present day. A set of factors and background phenomena contributing to the existence, transformation into new conditions in society and the spread of offenses related to the movement of goods/objects across the customs border were identified. Typical features of persons who commit these offenses were identified, depending on the role they perform in criminal groups. The modern conceptual model of organized crime has been improved in terms of analysis of amorphous structures as a modern type of criminal groups. An approach to the prevention of offenses related to the movement of goods/objects across the customs border was presented as part of cross-border cooperation in regulatory and organizational contexts. The legal instruments for the prevention of offenses related to the movement of goods/objects across the customs border at the present stage were described. The problems of interaction of subjects of crime prevention related to the movement of goods/objects across the customs border in Ukraine were revealed.
