Singaevska M. Land relations in Ukraine as an object of criminal law protection

The dissertation is a comprehensive scientific research of the issues of criminal and legal protection of land relations. It analyzes the theoretical and methodological bases of research of features of criminal liability for violation of land relations. The foreign experience of establishing criminal liability for violation of land relations has been studied. The characteristic features of land relations as an object of criminal offense have been established. The paper identifies the main and additional objects of criminal offenses in the field of land relations, describes the features of the physical elements, the subject and the mental elements of such offences. It examines the distinguishing features between the institute of criminal liability for violations in the field of land relations and the institute of the administrative liability. The thesis highlights the issues of reforming the institute of criminal liability in the field of land relations, develops and proposes the main criteria for distinguishing between criminal and administrative offenses in this field. The rules on how to qualify abuse of power or official position and official forgery in case of their commission in the field of land relations have been defined in the present paper. It has been proposed to amend and complement the relevant provisions of the Criminal Code of Ukraine establishing liability for criminally unlawful violation of land relations.
