The dissertation is the first special comprehensive study of the proper exercise of the right to build a land plot in the domestic science of civil law. The dissertation defines the content of the concepts “building” and “right to build”, distinguishes the concepts of “building” and “construction”, “construction” and “reconstruction”. The appropriate grounds and methods of acquiring the right to build in accordance with civil law have been determined and the necessary scope of this right for its further proper exercise has been clarified. A scientifically substantiated system of conditions for the proper exercise of the right to build a land plot has been formed. The legal construction of spontaneous construction as a form of improper exercise of the right to build is analyzed. The main problems of domestic legislation in the field of regulating the exercise of the right to build and acquire ownership of construction sites have been identified and critically considered. The directions of scientific research and prospects of improvement of legal regulation of relations on realization of the right to build are defined, the modern tendencies of development of legal relations on realization of the subjective right to build are considered.
