Kedik V. Universal and real principles of the operation of the law of Ukraine on criminal liability in expanse

Dissertation is one of the first in the Ukrainian science of criminal law with a special complex study of theoretical and practical aspects of the principles of criminal law in expanse. Define the concept, content and features of the principles of the operation of the criminal law in expanse in criminal law. The content, concept and features of the principles of the operation of the criminal law in expanse in the criminal law doctrine are also investigated. The genesis of the formation of the principles of the operation of the criminal law in expanse in the criminal law doctrine and legislation of Ukraine has been clarified. The place and role of the principles of operation of the criminal law in expanse in the system of principles of criminal law are analyzed. The proposed author's definitions of the universal (cosmopolitan) and real principles of the operation of criminal law in expanse. It is substantiated that extra territoriality is intermediate between the territorial and universal principle, while extraterritoriality is intermediate between the territorial and real principles, when the real principle acts as an exception to the territorial principle. The significance of the principles of operation of the criminal law in expanse has been established. The work reveals the content, directions of implementation and outlines ways to solve the problems of implementing the principles of the operation of the criminal law in expanse in the field of criminal lawmaking. Scientifically substantiated proposals have been formulated for making amendments and additions to the legislation of Ukraine in the field of implementing the principles of the operation of the criminal law in expanse.
