The dissertation is one of the first in the domestic science of criminal law, a special comprehensive study devoted to the criminal-legal characteristics of illegal search work at an archaeological heritage site, destruction or damage to cultural heritage sites. The dissertation examines the historical and legal aspects and social conditioning of the establishment of criminal liability for illegal search work at an archaeological heritage site, destruction or damage to cultural heritage sites. The essential legal signs of illegal search work at an archaeological heritage site, destruction or damage of cultural heritage sites have been identified. A detailed criminal-legal characterization of the corpus delicti of illegal search work on an archaeological heritage site, destruction or damage of cultural heritage sites is proposed. The problematic issues of delimiting illegal search work at an archaeological heritage site, destruction or damage of cultural heritage sites from related crimes have been resolved. The relevant international legal legislation on illegal search work at an archaeological heritage site, destruction or damage of cultural heritage sites has been analyzed in order to identify certain trends and opportunities for mutual use of advanced experience in legislative regulation. Taking into account the trends in the development of criminal legislation on illegal search work at an archaeological heritage site, destruction or damage to cultural heritage sites, specific recommendations for its improvement and practice of application in this area have been processed and scientifically grounded. A new version of the article on illegal search work at an archaeological heritage site, destruction or damage of cultural heritage objects in the Criminal Code of Ukraine is proposed.
