Turchyn V. Administrative Legal Regulation of Electronic Services in the Field of State Registration of Real Estate Rights

The dissertation is the first complex scientific research devoted to the problems of administrative legal regulation of electronic services in the field of state registration of real estate rights. The object of the study is public relations that arise in the sphere of administrative legal regulation of electronic services in the field of state registration of rights to real estate. The subject of the study is the administrative legal regulation of electronic services in the field of state registration of real estate rights. The possible influence of blockchain technology on the reform of the sphere of registration of real rights to real estate in Ukraine has been studied. The administrative and legal aspects, the main advantages and disadvantages of this technology are analyzed, in particular, the risks that may arise in case of reckless use of blockchain for registration of real estate rights. In addition, foreign experience of countries in the administrative and legal regulation of electronic services in the field of registration of real estate rights through the prism of critical analysis is researched and analyzed and the priorities for implementing the relevant provisions in our national legislation are identified. The ways of improvement of the process of providing electronic administrative services in the field of state registration of real estate rights in Ukraine are determined and the corresponding amendments to the Law of Ukraine «On State Registration of Proprietary Rights to Real Property and Their Encumbrance» are proposed. The gap in the legislation in the field of state registration of real estate rights was identified and the conforming amendments were proposed to the legislative acts of Ukraine on improving the provided legal liability for offenses and violations in the field of state registration of real estate rights that caused significant damage to legally protected rights or interests of individual citizens, state or public interests or the interests of legal entities.
