Borysova Y. Grounds and Conditions of Tort Liability in Civil Law of Ukraine and the USA (comparative-legal analysis)

As a result of a comparative legal study: there are identified factors that in historical retrospect contributed to the formation of legal ideas about tort liability in Ukraine and the USA; there are defined the concept of tort liability in the civil law of Ukraine and the USA; there are defined legal and factual grounds of tort liability in the civil law of Ukraine and the USA; there are clarified general and special conditions of tort liability in civil law of Ukraine and the USA; there are defined the peculiarities and conditions of tort liability for non-property (moral) damage caused in the civil law of Ukraine and the USA, as well as for damage caused by defects in goods, works, services, in the civil law of Ukraine and the USA; there are made proposals to improve the legal regulation of relevant public relations in Ukraine.
