Zhdynyak N. The effectiveness of prohibitive criminal law norms

The dissertation is the first in Ukraine systematic and complex monographic study of the effectiveness of prohibitive criminal law norms. The paper substantiates the limits of the study and summarizes the methodological approaches to understanding the effectiveness of prohibitive criminal law norms. The concept of efficiency of prohibitive criminal law norms is formulated, the ratio of efficiency with related concepts (economy, usefulness, optimality, social value, truth and quality) is determined, the types of efficiency of prohibitive criminal law norms are investigated. The quality and mechanism of implementation of prohibitive criminal law norms are analyzed as criteria for conducting a qualitative and quantitative assessment of the effectiveness of norms. The conditions for the effectiveness of prohibitive criminal law are determined.
