Essay

The dissertation solves the scientific task of formulating the constitutional basis for further improvement of the legal regulation of the notary as a subject of protection of constitutional human rights in Ukraine. Among the final provisions, generalizations, conclusions and recommendations, the most important research and practical significance are as follows. Legal regulation of notary activity in Ukraine is a purposeful influence of public authorities on public relations with the participation of elements of the notary system in order to regulate them, as well as the protection and safeguarding of human rights. The purpose of the legal regulation of the notary is to ensure the human rights and law enforcement direction of notarial activities. The tasks of legal regulation of the notary as a subject of protection of constitutional rights are: a) inclusion of the notary in the number of subjects which carry out not only protection, but also protection, and guarantee of realization of constitutional rights; b) observance of constitutional principles related to the activity of the notary; c) clarification of the principles of notary activity in Ukraine; d) providing the population with notarial services taking into account the territorial feature; e) further improvement of state control over the activities of the notary in terms of protection of constitutional rights. The constitutional foundations of the legal regulation of the activities of the notary in Ukraine have the following characteristics: a) the close connection of legal regulation with legal influence; b) the predominance of normative regulation over casual (individual); c) functional-axiological orientation.
