Vyshnevskyi V. International legal regulation of the investigation of marine casualties and incidents.

The dissertation is devoted to the analysis of the procedure for the investigation of marine casualties and incidents and its international legal regulation. The main features of the approach to the conventional regulation of the investigation of marine casualties and incidents have been determined. Attention is also focused on the norm-setting activities of the International Maritime Organization on this issue. The features of the legal regulation of the investigation of marine accidents in the European Union have been studied. Particular emphasis is placed on the presence of separate bodies for the investigation of maritime casualties and incidents in most of the maritime states. A comprehensive analysis of the implementation of international legal norms for the investigation of marine casualties and incidents into the legislation of Ukraine has been carried out. A number of urgent amendments to the Ukrainian legislation have been proposed to bring it into line with the standards of international legal regulation of the investigation of marine casualties and incidents. It is planned to create in Ukraine a separate body to investigate marine accidents following the example of other maritime states, in particular, the member states of the European Union.
