The author’s personal contribution to the study of the prohibition of propaganda for war comprises the novel scientific concepts and conclusions presented in this dissertation. The author proposes an original periodization for the development of historiography of propaganda for war, establishing its main stages. The methodological toolkit for studying propaganda for war is outlined as a methodology of scientific cognition based on a combination of general legal, specialized legal (criminal law), and psychological legal methods. The work conceptualises a two-tier vision of propaganda for war that includes a set of interconnected elements ensuring comprehensive understanding of the phenomenon. The first level pertains to preventing propaganda for war, while the second level is aimed at directly eliminating propaganda for war altogether. Both levels are officially enshrined in parts 1 and 2 of Art. 20 of the International Covenant on Civil and Political Rights (ICCPR). The author suggests defining propaganda for war as any form of dissemination of views, facts, arguments, and other information, including knowingly untrue messages, incitement of domestic and international racial, religious, or national hatred that aims to instigate military conflicts or aggression. The distinction from conventional propaganda is highlighted, as the latter focuses on spreading arguments, rumours, and other information among individuals to foster the desired public opinion. The meaning and content of propaganda for war are defined by detailing its interdependent elements, namely incitement to war or aggression, isolation from any contact with the outside world, censorship and distortion of any action towards peace by international organisations, and obstruction of access to information on the viewpoints of other countries. The dissertation proves that norms related to prohibition of propaganda for war aimed at direct and public incitement to hostility or violence are, in fact, general international law norms and they impose obligations on the states. These very norms institute positive erga omnes obligations regarding the prohibition of propaganda for war, therefore there can be no derogations or deviations from them. Notably, Ukrainian legal doctrine does not differentiate between the terms “мова ненависті” and “мова ворожнечі”, which are treated as synonymous and equal translation-terms for hate speech, despite minor stylistic and semantic differences. In this regard, the author suggests combing the terms and using “мова ненависті та ворожнечі” hereafter, in order to highlight the relations and actions based on hatred that lead to actual conflicts and wars. Four aspects of hate speech are summarised as (a) spreading ideas based on racial superiority, (b) dissemination of ideas based on racial hatred, (c) incitement to racial discrimination, and (d) incitement to acts against any race or group of people of different skin colour or ethnic origin, as well as abetting or providing any support to racism-motivated behaviour, including financial resources. The author argues that key elements to establishing the fact of hate speech are intent, incitement, and unlawful consequences. The element of propaganda can be viewed through the lens of intent, i.e., propaganda should encompass only the statements made with the intention of instigating hostility; statements made with the intention of inciting others to hatred should be considered hate speech. It is substantiated that incitement is an element of propaganda for war and these two concepts and interrelated. The definitive and distinguishing element of incitement is the intent to incite others to hostility or violence. The author argues that direct and public incitement to aggression should be included as a crime in the Rome Statute of the International Criminal Court. The paper outlines the main aspects of the existing case practice of international military tribunals wherein propaganda is interpreted as a set of actions aimed at inciting towards hostilities or genocide, or as direct calls for specific illegal actions against specific persons, or as propagation of racial, national, or mental domination of one nation or group of people over others. Propaganda for war is considered as both a complete crime and an inchoate offense without direct negative social consequences, however, in the second case, the international practice has developed a concept of irreversibility and made it impossible to avoid punishment. The author further develops the notion that there is still no universal legal construct at the international level that would contain a comprehensive definition of propaganda for war and its negative manifestations as a binding normative legal act. Solution to this issue lies in the implementation of joint interstate mechanisms for concluding multilateral and bilateral international legal agreements.
