Tkachenko N. Administrative and legal counteraction to social orphanhood

The theoretical generalization and proposed a new solution to the scientific problem, which consists in the development of theoretical and practical issues of determining the legal nature, essence and content of social orphanism, the main areas of activity of specially authorized subjects of counteraction to social orphanism, as well as in substantiation of ways to increase the efficiency of administrative-forwardly providing their activities. The nature, essence and content of social orphanism as an object of administrative and legal research are analyzed. The basic signs of social orphanism have been clarified and their classification was conducted. The author's definitions of such concepts as «social orphans» and «social orphans» are substantiated, as well as the author's classification of the basic categories of children to be attributed to social orphans. The multilevel branching classification of such reasons has been developed. The essence and content of the prevention of social orphanism are characterized, as an integral part of its administrative and legal counteraction. The purpose, main tasks and directions of administrative and legal counteraction to social orphanages are determined. The scope of competence, tasks and powers of the Ministry of Social Policy of Ukraine, its system, structure and organizational construction, and also substantiates the need for measures aimed at improving its activities in the field of counteraction to social orphan. Provided deployed characteristics of the main task, functions and directions of activity of the national police in the field of administrative and legal counteraction to social orphan. The basic direction of social associations on counteraction to social orphanages, as well as the author's definition of the specified concept, is determined. The work of the main subjects of counteraction to social orphanism is generalized, the main goal, tasks and directions of their interaction, their author's differentiation are substantiated. The own system of basic forms of interaction of subjects of counteraction to social orphanages, as well as the author's system of principles of their interaction, is substantiated. The main international standards that should be based on the national mechanism of counteraction to social orphanages are determined. The foreign experience of prevention of social orphanism is analyzed and the most promising directions of its implementation in the national legal system are substantiated.
