Essay

The dissertation is a complex scientific research of criminal law protection of public procurement. The author argues that public procurement is derived from the concept of public procurement as an independent mechanism for regulating economic relations, which is used in different markets. It covers various areas of economic policy of the state: antitrust, anti-corruption, investment, innovation, foreign economic, industrial, small business development and pricing. The mechanism of public procurement is an important condition for the existence of such an institution in jurisprudence as public procurement. In the process of development of criminal law policy, public procurement was transformed into the concept of "public procurement". Despite the legal consolidation of the concept of "public procurement", among scholars, and even more so practitioners, there is no unanimity on this issue, but more and more often this concept is associated with the concept of tender (actually bidding). Implementation of public procurement procedures is a rather complicated procedure that causes risks of committing offenses in this area (including corruption and fraud), which causes such negative factors as misuse of budget funds, their inefficient use, resulting in underfunding of the state budget. Irrational and inefficient spending of budget funds, non-fulfillment of budget commitments by the state exacerbates social problems, as the gap between the majority of the population who are forced to survive and those who get rich quickly by misappropriating budget funds is growing. Because of the impunity of officials who steal budget funds, the law is discredited, and the public consciousness is convinced that citizens are vulnerable to crime and to the authorities.
