The dissertation is devoted to the study of theoretical and legal problems of regulating the sphere of activity of public organizations in Ukraine. The feasibility of the conducted scientific research is due to the content of democratic changes, which began with the adoption of the Declaration on State Sovereignty of Ukraine on July 16, 1990, the Act of Proclamation of Independence of Ukraine on August 24, 1991. The introduced nationwide measures acquired qualitatively new qualities with the adoption of the Constitution of Ukraine. Such changes are inextricably linked with dynamic processes in the public life of the Ukrainian people, which permanently occur in the social, political, economic and other spheres. At the same time, Ukraine's progressive movement towards joining the European Union and NATO contributes to increasing the level of public control over the activities of state and government institutions, counteracting the manifestations of corruption and illegal enrichment of representatives of government bodies, local governments and other entities related to solving domestic, labor and other problems by the forces of caring ordinary Ukrainians.
Issues related to the formation of a legal state, the establishment of the constitutional principle of the rule of law and other guarantees provided for by the provisions of the Basic Law are in the process of implementation. This task is extremely complicated by the events of February 24, 2022, when the Russian Federation invaded Ukraine on a full-scale scale. Given the objective circumstances, it was concluded that such tasks cannot be accomplished without the active involvement of the majority of society in participating in the specified areas and the creation of an appropriate regulatory and regulated basis for conducting such activities on the principles of democracy and strict observance of human and civil rights, primarily during the repulsion of Russian aggression.
Given the judgments expressed by scientists that a mature civil society has not yet been formed in Ukraine, and the level of its readiness is assessed as "a state of transit", the urgent tasks facing the state are those related to the formation of independent voluntary associations that consolidate society and ensure its effective interaction with state authorities and local self-government. It is the level of participation of the people through the spread of the influence of public organizations on the course and direction of the processes of national state building that largely reflects the degree of development of civil society.
In the context of the above, a special place in the dissertation research is given to the justification of the need to expand the boundaries of citizens' participation in the processes of state formation by establishing public organizations and involving a wide range of individuals in their work. Among the main areas of activity of such non-governmental organizations, the tasks of protecting human rights and fundamental freedoms occupy a prominent place. However, the current situation does not fully comply with the provisions of the legislation on the development of self-organized non-governmental human rights and other socially oriented organizations. This state of affairs necessitates the improvement of the current legislation regulating the activities of public organizations, and in many cases, amendments to those legal provisions that have lost their relevance or do not fully correspond to the real situation in society.
The European course of Ukraine has had a significant impact on the understanding by the broad masses of the true essence of democratic processes, in which constitutional guarantees acquire real significance as instruments for regulating social relations on the basis of equality of all before the law and the true rule of law.
